At a Glance
This is the agreement between you and Forge. We’ve written it in plain English so you can actually read it. If you create an account or use the Forge app or website, this agreement applies to you.
The short version:
- Forge is a fitness tracker with an AI Coach. It is not a doctor, a personal trainer, or a substitute for professional advice. Talk to a qualified professional before starting any exercise program.
- Free, Pro, and Elite subscriptions are billed through the Apple App Store or Google Play. We do not handle your payment directly.
- You agree to use Forge for its intended purpose and not to abuse the service or other users.
- We provide the service “as is” and our liability is limited.
- If we end up in a legal dispute, it goes to court in Oregon under Oregon law.
The rest of this document explains all of this in more detail.
1. Acceptance of These Terms
By creating a Forge account, signing in to Forge, or using any part of the Forge service, you agree to these Terms of Service.
If you do not agree, do not create an account or use the service.
You are also agreeing to our Privacy Policy, which explains what we do with your data. The Privacy Policy is incorporated into these terms by reference.
2. Who Can Use Forge
To use Forge, you must:
- Be at least 13 years old.
- Be a resident of the United States.
- Have the legal capacity to enter into a binding agreement under the laws of your state.
Forge is not directed at users outside the United States. See the “Where Forge is offered” section of our Privacy Policy for details on this.
If you are under 18, you confirm that you have permission from a parent or legal guardian to use Forge.
3. Your Account
You sign in to Forge through Google or Apple. We do not store your password. Your sign-in credentials are managed by your sign-in provider.
You agree to:
- Keep your sign-in credentials secure. If your Google or Apple account is compromised, your Forge account is too.
- Use only one account per person. Do not share your account with others.
- Provide accurate information when you choose to provide any optional information.
- Notify us at help@forgeworkouts.com if you believe your account has been accessed without your permission.
You are responsible for all activity that happens through your account.
4. The License We Give You
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Forge for your own personal, non-commercial fitness tracking. This license exists only while you are in compliance with these terms.
This license does not give you the right to:
- Resell, sublicense, or commercially exploit Forge or any part of it.
- Use Forge to build a competing product or service.
- Strip our trademarks, copyright notices, or other proprietary markings from any part of Forge.
5. The License You Give Us (for Your Content)
You own the data and content you put into Forge: your workouts, your custom exercises, your templates, your notes, your goals, and everything else you create or enter. We do not claim ownership of any of it.
To run Forge, however, we need permission to do certain things with that content. By using Forge, you grant us a limited license to:
- Store your content on our infrastructure.
- Display your content back to you across your devices.
- Process your content through our AI service providers (currently Anthropic and OpenAI) when and only when you use the AI Coach or voice-to-text features. See the Privacy Policy for details on what happens with that data.
- Share your content with Partners you have explicitly linked, only for the categories you have opted in to share. See the Privacy Policy for details on the Partner system.
- Use your content in fully de-identified, aggregate form to understand and improve Forge as a product.
This license is non-exclusive, royalty-free, and worldwide (only to the extent needed to operate the service on infrastructure that may not be located in the United States).
We do not use your content for:
- Marketing or promotion without your explicit, separate consent.
- Training general-purpose AI models. Our agreement with Anthropic specifically prohibits training on your data.
- Sale, licensing, or sharing with third parties for those third parties’ own purposes.
This license ends when you delete your account, except for de-identified aggregate data which may persist.
6. Acceptable Use
By using Forge, you agree not to:
- Reverse engineer, decompile, or disassemble the Forge app or service, except where the law specifically allows it and we cannot prevent it.
- Copy, clone, or create a competing product based on Forge or any part of it.
- Scrape, harvest, or extract data from Forge using automated tools, bots, or any other means we have not specifically authorized.
- Misrepresent yourself or your activity in Forge. This includes impersonating others, falsifying workout data submitted to Partners, or making false claims about the service.
- Abuse the AI Coach by attempting to extract its system instructions, generate output that violates Anthropic’s usage policies, or driving up token usage in bad faith.
- Abuse the Partner system by sending unsolicited codes, harassing Partners through shared data, or sharing data with people the data subject did not expect.
- Use Forge for any illegal purpose or in a way that violates the rights of others.
- Interfere with the service by overloading our servers, exploiting bugs, or attempting to disrupt other users.
We may suspend or terminate your account if you violate these rules.
7. Security Research and Bug Reports
If you discover a bug or security vulnerability in Forge, we genuinely want to know about it. Please email security@forgeworkouts.com with the details and we will make our best effort to address it.
Important things to understand:
- We do not offer paid bug bounties. There is no implicit or explicit payment obligation when you report a bug, regardless of severity.
- You may not perform unauthorized security testing against Forge. This includes vulnerability scanning, penetration testing, fuzzing endpoints, attempting to access other users’ data, or otherwise probing our defenses without a written agreement with us in place.
- The risk of unauthorized testing is on you. If you breach Forge’s security in the course of “testing” without authorization and in doing so access other users’ personal information, you may have committed a felony under federal or state computer fraud laws. Reporting it to us afterward does not eliminate that risk.
Legitimate, good-faith bug reports about issues you encountered during normal use of the service are always welcome. Active probing or testing without authorization is not.
8. The AI Coach
The AI Coach is a feature that uses large language models to help you understand your training, answer questions about exercise, and provide context on the data you have logged in Forge. It is available on the Elite subscription tier and on a limited bonus basis to Pro subscribers.
The AI Coach is informational, not professional advice.
- The Coach is not a doctor. It does not diagnose, treat, or prescribe anything. It is not authorized to give medical advice and we do not intend for it to.
- The Coach is not a personal trainer. It does not know your full physical condition, medical history, or movement capability. It cannot evaluate your form. It is not a substitute for working with a qualified trainer.
- The Coach is not a nutritionist, physical therapist, or other licensed professional.
- The Coach can be wrong. Large language models occasionally produce inaccurate, outdated, or confidently incorrect information. You should not rely on the Coach’s output as definitive on any matter, especially anything health-related.
- You should use your own judgment. When the Coach makes a recommendation, you decide whether to follow it. You should consult a qualified professional for important decisions about your health or training.
If you ask the Coach about an injury, a medical concern, a medication, or anything else where a real professional opinion matters, the Coach is configured to recommend you talk to a qualified professional. We encourage you to follow that recommendation.
Coach usage and limits
Forge meters AI Coach usage in units called SPARKs. A SPARK is a cost-normalized version of a token (the basic unit large language models use to measure input and output). Tokens are normally billed at different rates depending on whether they are input or output tokens. SPARKs combine both into a single, simpler unit so that you can understand your usage without needing to know the underlying token economics.
Your tier determines your SPARK allotment:
- Elite subscribers receive a recurring weekly SPARK allotment.
- Pro subscribers receive a limited bonus SPARK allotment that allows them to try the Coach.
- Free users do not have access to the Coach.
When you reach your SPARK limit:
- Elite users can continue using the Coach after their weekly reset.
- Pro users using the bonus allotment cannot use the Coach further until they upgrade to Elite. The Pro bonus does not reset.
We may run occasional promotions that grant additional SPARKs on a one-time basis. Promotional SPARKs are not part of any tier’s ongoing allotment and do not establish any obligation to provide additional SPARKs in the future.
The specific number of SPARKs included in each tier is described at www.forgeworkouts.com and visible in your in-app usage indicator. Allotments, pricing, and tier features are subject to change. We will announce material changes to SPARK allotments through the in-app “What’s New” section.
9. Health and Fitness Disclaimer
This section is important. Please read it.
Exercise carries inherent risks, including injury and, in rare cases, serious medical events. Forge is a tool for tracking and understanding your training. It is not a guarantee of safety, results, or fitness for any particular activity.
By using Forge, you acknowledge and agree that:
- You should consult a qualified medical professional before starting any new exercise program, changing your training significantly, or undertaking any activity that could affect your health.
- You exercise at your own risk. Forge does not assess your physical condition, fitness for exercise, or readiness for any specific activity. We have no way to know whether a given exercise is safe for you.
- You are responsible for your own decisions about what to train, how hard to train, when to rest, and when to stop.
- You should stop immediately and seek help if you experience pain, dizziness, shortness of breath, chest discomfort, or any other symptoms that concern you during or after exercise.
- Forge does not guarantee any specific results from using the service, including weight changes, strength gains, performance improvements, or any other outcomes.
Nothing in Forge, including the AI Coach, exercise libraries, templates, plans, or analytics, is medical advice or a substitute for professional medical, training, nutritional, or psychological care.
10. Subscriptions, Billing, and Refunds
Forge offers three tiers: Free, Pro, and Elite. The features included in each tier are described at www.forgeworkouts.com and in the app. Paid tiers may be offered on monthly or annual billing periods. The current price, billing period, and auto-renewal terms are displayed in the in-app subscription screen at the time you subscribe. Tier features, billing periods, and pricing are subject to change.
Where billing actually happens.
All paid subscriptions to Forge are billed through the Apple App Store or Google Play depending on the platform you signed up on. When you subscribe to Pro or Elite:
- You are entering a billing relationship with Apple or Google, not with Forge Health and Fitness LLC.
- The price, currency, taxes, and renewal terms are set and managed by the app store.
- Forge receives a portion of the subscription fee from the app store after the app store’s processing.
We provide the service. The app stores handle the money.
Auto-renewal.
Paid subscriptions auto-renew through the app store unless you cancel them. The app store will renew your subscription at the end of each billing period using the payment method on file with that app store. Apple and Google control when and how renewal notifications are sent.
Cancellation.
You can cancel a subscription at any time directly in your Apple App Store or Google Play subscription settings. We cannot cancel subscriptions on your behalf, because we don’t process the billing.
When you cancel:
- If you simply turn off auto-renewal, your subscription remains active until the end of your current billing period. You keep your tier entitlements until then.
- If you cancel and request an immediate refund through the app store (and the app store grants it), your tier entitlements end at the time the refund is processed.
Refunds.
Refunds are handled by Apple and Google according to their policies, not by Forge. To request a refund, contact the app store you subscribed through. We have limited ability to influence refund decisions and generally cannot grant refunds directly.
11. Changing Tiers (Upgrade and Downgrade)
Upgrading.
When you upgrade to a higher tier, your new entitlements (more features, higher limits, etc.) typically take effect immediately. Billing for the upgrade is handled by the app store.
Downgrading.
When you downgrade to a lower tier, your entitlements drop to the new tier’s limits. This has practical effects on data you have created at the higher tier:
- Your data is not deleted. Data created at a higher tier (such as templates beyond the new tier’s limit, additional goals, or pinned items) is hidden, not removed.
- Limits are imposed automatically. Forge does not ask you to choose which items to keep accessible. The new tier’s limits apply to your account, and items beyond those limits are hidden by the rule the limit applies (such as most recent kept, oldest hidden, etc., as configured in the app).
- Re-upgrading restores access. If you later upgrade again, hidden items become accessible again. They were always there.
- You are responsible for accepting these effects. By downgrading, you agree that hidden items are not accessible during the downgrade period, even though they remain stored.
Partner system on downgrade. The Partner system has tier implications that are worth understanding:
- Free users can establish Partner links and share their own data outward, but cannot view data shared by their Partner.
- Pro and Elite users can both share data and view their Partner’s shared data. (Generating new Partner codes requires Pro or higher.)
When you change tiers:
- Elite to Pro: No change to your Partner functionality. Both tiers can share and view data.
- Pro or Elite to Free: You lose the ability to view data shared by your Partner. The link itself remains established, and you can continue to share your data outward if you have data sharing turned on. If you later re-upgrade, your viewing access is restored.
- Both you and your Partner on Free at the same time: The link remains established but neither of you can view the other’s data. Each of you can still share data outward. The link becomes useful again as soon as one of you re-upgrades.
In short, downgrading does not destroy your Partner links. It pauses the parts of the relationship that require a paid tier on your side, while leaving the link in place for you to restore later.
12. Service Availability and Modifications
We aim to keep Forge available and working well, but we do not guarantee uninterrupted access. Things that can affect service availability include planned maintenance, third-party outages (Supabase, Anthropic, OpenAI, Apple, Google, your internet connection), bugs, and events outside our control.
Notifications about service status. We will make a best effort to notify you about service issues and scheduled maintenance through in-app advisory banners. For example, if our AI provider Anthropic experiences an outage that affects the Coach, we will attempt to display a banner on the Coach screen indicating that the service is temporarily unavailable. For planned maintenance that may affect active workout sessions or other key features, we will make a best effort to display advance notice through an in-app advisory banner that includes the relevant details.
Not all downtime is predictable, and we cannot always provide advance notice or even real-time notice during an outage. These commitments are best-effort, not guarantees.
Offline use. Forge includes limited offline functionality for accessing your existing data and logging new workouts when you do not have an internet connection. This is intended as a convenience for situations where connectivity is unreliable, such as inside some gym buildings. When your device reconnects to the internet, Forge will make a best effort to synchronize any data you logged offline back to our servers.
You should not rely on offline mode as a primary way to use Forge. Realistically, Forge requires an internet connection to provide its full functionality. Some features (including the AI Coach, voice-to-text, data sync with Partners, and platform health system integrations) are not available offline at all.
We are not liable for data lost during offline use. If a sync fails for any reason (such as a device failure, an app crash before sync completes, or a conflict between offline changes and server state), we cannot guarantee that we can recover the affected data. You should treat offline-logged data as provisional until it has successfully synchronized.
Modifications and discontinuations. We may modify, suspend, or discontinue any feature or aspect of Forge at any time. For significant changes that affect your subscription tier or core functionality, we will announce them through the in-app “What’s New” section as described in our Privacy Policy.
13. Warranties Disclaimer
Forge is provided “as is” and “as available”. To the maximum extent allowed by law, we disclaim all warranties, whether express or implied, including but not limited to:
- Warranties of merchantability (that the service is fit for sale).
- Warranties of fitness for a particular purpose (that the service will achieve any specific result for you).
- Warranties of non-infringement.
- Warranties of uninterrupted, error-free, or secure operation.
In plain English: we will do our best to make Forge work well for you, but we cannot guarantee specific results, perfect uptime, error-free operation, or that the service will meet your specific needs.
14. Limitation of Liability
To the maximum extent allowed by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages that arise out of or relate to your use of Forge. This includes lost profits, lost data, missed workouts, business interruption, or any other indirect losses.
- Our total liability to you for any direct damages arising out of your use of Forge is limited to the greater of (a) the total amount you paid us through subscriptions in the 12 months before the event giving rise to the claim, or (b) one hundred US dollars ($100).
- Some states do not allow the limitation or exclusion of certain damages. Where that is the case under the laws of your state, the limits above apply only to the extent the law permits.
In plain English: if something goes wrong with Forge, we are not financially responsible for downstream losses, and our total financial responsibility is capped at a relatively small amount. This is the kind of limitation that makes it possible for indie products like Forge to exist.
Health and injury exclusion. Nothing in this section eliminates the disclaimers in Section 9. You exercise at your own risk and Forge is not financially responsible for injuries, health events, or related losses arising from your training activities, your use of the AI Coach’s suggestions, or your decisions about how to train.
15. Indemnification
You agree to defend, indemnify, and hold harmless Forge Health and Fitness LLC and its officers and employees from any claims, damages, or expenses (including reasonable legal fees) that arise out of:
- Your violation of these Terms of Service.
- Your violation of any law or the rights of any third party.
- Your misuse of the service, including misuse of the AI Coach or the Partner system.
- Content you create in Forge that violates the rights of others (such as defamatory content in custom exercise descriptions or workout notes).
In plain English: if you break the law or break these terms in a way that gets us sued, you cover our costs of dealing with that.
16. Termination
You can terminate at any time. You can delete your account through the in-app settings at any time. Doing so triggers the anonymization process described in the Privacy Policy.
We can terminate or suspend your account if you violate these terms, abuse the service, or use Forge in a way that creates legal or operational risk for us. Where it is reasonable to do so, we will give you notice and an opportunity to address the issue first.
What happens to your data on termination. This is governed by our Privacy Policy. In short: deleting your account anonymizes your data and removes your profile. If we terminate your account for cause, the same process applies.
Survival. Even after termination, the following sections remain in effect: Section 5 (to the extent of any aggregate or de-identified data we retain), Section 13 (Warranties Disclaimer), Section 14 (Limitation of Liability), Section 15 (Indemnification), Section 20 (Governing Law and Dispute Resolution), and any other section that by its nature should survive.
17. Intellectual Property
Forge owns the Forge app, the Forge website, the underlying software, the Forge name and logo, the AI Coach’s design and prompt engineering, the exercise library structure, and all other materials we have created.
You own the content you create within Forge: your workout data, custom exercises, templates, goals, habits, notes, and conversation content. See Section 5 for the limited license you grant us to use this content to operate the service.
Trademarks. “Forge” and “Forge Workout Tracker” are trademarks of Forge Health and Fitness LLC. You may not use these marks without our written permission, except to refer to Forge in a way that is accurate, non-misleading, and does not suggest endorsement.
18. Changes to These Terms
Forge will change over time, and these terms may need to change with it. We want to be honest about how those changes are communicated.
For most changes, including the addition of new features and most operational refinements, we will update these terms and announce the change in the in-app “What’s New” section at the time the change takes effect. The “Last Updated” date at the top will tell you when it last changed.
For significant changes (such as changes to fees, dispute resolution, limitations of liability, or fundamental commitments), we will make a best effort to announce the change in the in-app “What’s New” section in advance.
Minor changes (clarifications, formatting, typo fixes) may be made without separate notification.
A note on how we communicate. Forge does not send marketing or notification emails of any kind. This includes emails about changes to these terms. Because of this, we encourage you to review these terms from time to time.
If you do not agree to a change, stop using Forge and delete your account.
19. If Forge Changes Ownership
If Forge Health and Fitness LLC is ever acquired, merges with another company, or sells substantially all of its assets, these terms and the Privacy Policy will transfer to the new owner along with your data. The new owner inherits the terms as a starting point and may update them going forward under the same procedures described in this document.
See Section 19 of the Privacy Policy for our full commitments around what happens in an ownership change.
20. Governing Law and Dispute Resolution
These terms and any dispute arising out of your use of Forge are governed by the laws of the State of Oregon, without regard to its conflict of laws principles.
Any legal action arising out of these terms or your use of Forge must be brought in a state or federal court located in Clackamas County, Oregon, and you consent to the personal jurisdiction of those courts.
We have intentionally not included a mandatory arbitration clause or a class action waiver. If you have a serious enough dispute with us to want to pursue it in court, including as part of a class action, you may do so. We hope it never comes to that, and we will work in good faith to resolve disputes through direct communication first.
If you have a dispute or concern, please contact us at legal@forgeworkouts.com before pursuing any legal action. We will make a genuine effort to resolve issues directly.
21. Miscellaneous
Entire agreement. These Terms of Service and the Privacy Policy together form the entire agreement between you and Forge regarding the service. They replace any prior agreements, communications, or understandings, written or oral.
Severability. If any part of these terms is found to be unenforceable, the rest remains in effect. The unenforceable part will be modified to the minimum extent necessary to make it enforceable, or removed if no modification will work.
No waiver. If we don’t enforce a particular part of these terms in a specific situation, that doesn’t mean we waive the right to enforce it later or in a different situation.
Assignment. You may not transfer or assign your account or your rights under these terms to anyone else. We may transfer these terms to a successor in the event of an acquisition, merger, or sale of assets, as described in Section 19.
Force majeure. We are not responsible for failure to perform under these terms when the failure is caused by circumstances beyond our reasonable control, such as natural disasters, war, terrorism, labor disputes, internet outages, or actions of third-party providers we rely on.
Headings. Section headings in this document are for convenience only and do not affect the meaning of the terms themselves.
22. Contact Us
If you have any questions about these terms, contact us at legal@forgeworkouts.com.
Change Log
Notable changes to these terms are logged here, most recent first. We add an entry whenever we make a substantive update.
